In large exposure cases, excess liability insurers often have the deepest available pockets. Understanding the rights and obligations of excess insurers is critical to effectively managing significant litigation. This program addressed, both from a legal standpoint and practically, various key issues including: notice, duties between primary and excess carriers (as well as policyholders with significant SIRs), excess carriers’ access to information, defense related issues, and settlement issues (“hammer” letters, underlying exhaustion, and settlement terms).
